Effective Date: March 31, 2025Welcome to Khalo! Our goal is to support you in your health journey with an app experience that’s as smooth as it is helpful. These Terms of Service ("Terms") govern your use of Khalo’s website ("Website"), mobile applications ("App(s)"), and services (collectively, the "Services").
By accessing and using the Services, signing up for an account, or indicating your consent, you agree to these Terms, our Privacy Policy, and Community Guidelines (collectively, the "Khalo Terms"). If you do not agree, you may not use the Services.THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER IN SECTION 12. PLEASE REVIEW CAREFULLY.1
Eligibility and Account ResponsibilitiesYou must be at least 18 years old to use Khalo. By using Khalo, you represent that you meet this requirement and that any information you provide is accurate and up to date.You agree to create only one personal account, not to share your account with others, and to keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us at [email protected] immediately if you suspect unauthorized access.2
Content and Intellectual Property"Content" includes all materials made available through the Services, including nutritional data, images, text, designs, and more. "User-Generated Content" is anything you provide, like logged meals, comments, or diary entries.
All rights to Khalo content belong to Khalo or its licensors. We grant you a personal, non-exclusive, non-transferable license to use the Services for personal, non-commercial use only. You may not sell, distribute, or modify our content.
When you provide User-Generated Content, you grant us and our users a worldwide, royalty-free license to use, reproduce, display, and adapt that content, subject to our Privacy Policy. You must have all rights to share any content you submit.3
Health and Wellness InformationKhalo is not a medical service. All content is for general informational purposes only and should not be considered medical advice. Always consult a healthcare professional before beginning a new diet, exercise, or wellness routine.
We are not liable for the accuracy or completeness of nutritional data, including user-submitted data in our food database. You are responsible for verifying any data you rely upon, especially with regard to allergies or dietary needs.4
Restrictions on UseYou agree not to:
• Use the Services for any unlawful purpose
• Scrape, harvest, or collect data from the Services without permission
• Disrupt the functionality or security of the Services
• Introduce malware, viruses, or harmful code
• Infringe on others' rights through your use of the Services5
Third-Party ServicesKhalo may link to or interact with third-party services, such as fitness trackers or grocery databases. These services may have their own terms and privacy policies. We are not responsible for their content or practices.6

No WarrantiesServices are provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, including merchantability and fitness for a particular purpose. We do not guarantee accuracy or availability.8
Limitation of LiabilityTo the maximum extent permitted by law, Khalo shall not be liable for any indirect, incidental, or consequential damages, or loss of data, profits, or goodwill. Our total liability shall not exceed $500 or the amount you paid (if any) in the last 12 months.9
Indemnity You agree to indemnifyKhalo from any claims or losses resulting from your use of the Services, your content, or your violation of these Terms.10
Governing LawThese Terms are governed by the laws of New York, USA, without regard to conflict of laws principles.11
Dispute ResolutionAll disputes must first go through informal resolution for 60 days. If not resolved, disputes shall be resolved through binding individual arbitration (not court), under AAA Consumer Arbitration Rules. You waive the right to jury trials and class actions.

International UseBy using Khalo outside the U.S., you agree to comply with local laws and consent to transferring your data to the U.S. You may not use the Services if you are subject to U.S. sanctions.13
SurvivalThe provisions that reasonably should survive termination (including ownership, disclaimers, limitations of liability, and dispute terms) shall survive.14
